SMS consent and opt-in process

This page describes how customers of operators using our platform receive SMS, how they consent, and how they opt out.

Who receives messages from this platform

Customers of independent landscape and lawn-care operators who use Mi Capataz to manage their business communications. All recipients have a pre-existing service relationship with the sending operator and have explicitly opted in to receive SMS as described below.

Call to Action — how consumers opt in

Mi Capataz operates a tightly-scoped, consumer-initiated opt-in model. There are two documented opt-in paths, and a consumer is only added to our SMS list if they affirmatively complete one of them. Consenting to SMS is never a condition of becoming a customer of an operator or of receiving service from them.

  1. Web opt-in form (primary CTA). The consumer visits micapataz.com/opt-in, enters their name, mobile number, and the business name of the operator they hired, and ticks the consent checkbox containing the verbatim consent language shown below. The consent checkbox is unchecked by default, and the page states clearly that opting in to SMS is not a condition of receiving service from the operator.
  2. Operator’s signed intake form. Operators may include an OPTIONAL SMS consent checkbox on their customer intake forms. This checkbox is unchecked by default, clearly labeled as optional, and the intake form is processed by the operator regardless of whether the SMS box is ticked. Consenting to SMS is never required to become a customer of the operator or to receive service from them.

Verbatim consent language

Whichever path the consumer chooses, the language they accept is functionally identical:

I consent to receive SMS messages from Mi Capataz (a service of K AND D AUTOMATION LLC) on behalf of [operator business name] regarding estimates, invoices, payment reminders, and appointment reminders for services I have purchased. Consent is not a condition of purchase or of receiving service. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to opt out.

What messages we send

Confirmed customers receive transactional SMS related to their service relationship with the operator:

  • Invoices for completed services with a payment link.
  • Estimates for proposed services.
  • Payment reminders for unpaid invoices (rare, only with operator approval).
  • Service confirmations for recurring appointments.

We do not send promotional or marketing messages. Frequency typically 1–8 messages per month, depending on service frequency.

How customers opt out

Recipients can reply STOP at any time to opt out of all platform-sent messages from that operator. Opt-out is honored immediately and permanently. Customers who opt out can be re-added only by completing the opt-in form at micapataz.com/en/opt-in again.

How customers get help

Recipients can reply HELP to receive a message with the operator’s contact information.

Data handling

We retain consent records and message logs to demonstrate compliance with TCPA and carrier requirements. We do not share recipient phone numbers with third parties for marketing purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
